What does it mean to “post bail”?
To better explain what might seem like confusing legal jargon, bail is an amount set by the court that will allow you or your loved one to be released from jail. This amount is typically a standard amount based on the charges, but can vary based on the following factors:
- The charge: the more serious the offense, the higher the bail
- The defendant’s criminal history, if any
- The defendant’s ties to the community – Does he or she have children? Is he or she married? Is her or she a home owner? etc.
- The defendant’s employment history and current employment – someone with a job is more likely to stay in the area
Once you pay the bail amount, the bail is posted and your loved one is released from jail.
What is a bail bond?
Bail amounts are typically significantly higher than what a person actually pays to be released from jail. This is when bail bonds come in. A bail bond is a promise to or agreement with the court that the defendant will appear in court on the date assigned to them and follow the boundaries and requirements set upon their release from jail. The bail bond amount is typically around 10 percent of the full bail amount. Once paid, the jail can release the defendant back home.
